- Report criminal activity to local police

### Shipping & Delivery

#### Shipping Responsibility

BabyMarket.deals does not handle, store, or ship any physical items. We buy the carrier label on the seller's behalf through our own shipping account and make it available to the seller. Packaging the item, and handing the parcel over to the carrier at a drop off point, remain the responsibility of the seller. Proper packaging means a rigid cardboard box that stays within the dimensions and weight entered on the listing.

#### How Shipping Works

- Buyer selects shipping method during checkout with real-time pricing
- Shipping cost is calculated automatically based on package specs
- Seller receives payment and shipping notification
- We buy the shipping label from the carrier and make it available to the seller
- Seller packages the item and drops the parcel off at the carrier
- Tracking number is shared with buyer

#### Package Dimensions, Category & Review Process

Accurate category selection, package dimensions, and package weight are essential for correct carrier pricing, label generation, delivery handling, and search results. Sellers must list each item in the most appropriate category and subcategory, and must enter package details that reasonably match the listed item and its packaging.

- Package dimensions and weight must reflect the actual parcel size and weight, not placeholder values or estimates that are clearly too small
- Each listing must describe one sellable item or one logical bundle that can be shipped together in a single parcel
- If a listing appears inconsistent, for example a stroller declared as 1 x 1 x 1 cm, a large item placed in the wrong category, or multiple large items combined in one listing, we may review the listing manually
- When the correct category, subcategory, package dimensions, or package weight are reasonably clear from the listing title, description, photos, or product type, we may update the listing ourselves to keep the marketplace accurate and the shipping calculation reliable
- If we update a listing, we may notify the seller by email with the changes made and the reason for the update
- If the issue cannot be corrected by us, or if the listing needs seller input, we may email the seller to request clarification or corrected information
- If no reply is received, we may send one reminder after 24 to 48 hours
- If no reply arrives after that reminder, or if the listing cannot be safely corrected, we may hide or cancel the listing until the issue is resolved
- The seller may contact us if they believe a correction was made in error

#### Available Carriers

We provide integrated shipping solutions with access to multiple carriers:

- PostNL (standard and express options)
- DHL (express delivery)
- DPD (next-day delivery)
- UPS, FedEx, GLS, and other available carriers

#### Carrier Surcharges

Carriers measure and inspect parcels after hand over. When a parcel does not match the label it was bought for, or is not packed to the carrier's standard, the carrier charges us an extra amount. That charge reaches us days or weeks after delivery, often after the seller has already been paid. Where the extra cost is caused by how the seller packed or declared the parcel, we recover it from the seller at the amount the carrier charged us, with no mark up.

- Recoverable from the seller: packaging the carrier cannot handle, such as an item sent in a bag, wrapped in plastic, in an envelope, or in its own retail packaging instead of a rigid cardboard box
- Recoverable from the seller: a parcel larger or heavier than the dimensions and weight entered on the listing. A parcel smaller or lighter than declared is never charged for
- Recoverable from the seller: the carrier's fee for a label that was not scanned at the drop off point, and any other correction the carrier attributes to the parcel itself. Hand the parcel to the staff and wait for the scan; that scan is also your proof of hand over. Costs caused by the buyer, such as a wrong delivery address or a redelivery, are never recovered from the seller
- Where the carrier also credits us for the same parcel, for example because it measured smaller than declared, that credit is set off first and only the remaining amount is recovered
- We deduct the amount from the seller's Stripe balance when the payout for that order is released, 15 days after the purchase and at least 12 days after the carrier scan, and pay out the rest
- Where a charge reaches us only after the payout has left, we email the seller the carrier's own charge lines with a link to pay the amount by iDEAL within 14 days. If another payout to the seller is released first, we deduct the amount from that payout instead and the seller does not need to pay it separately
- We email the seller when we recover an amount, showing the carrier's own charge lines and the reason
- A seller who believes a charge is wrong can contest it by replying to that email within 14 days, and we correct it if the carrier reverses or adjusts the charge
- If an amount is still unpaid 14 days after that email, we pause the seller account and hide its listings until it is paid. Paying lifts the pause straight away. An amount below €0.50, which cannot be paid online, is deducted from the seller's next payout instead and never leads to a pause

#### Important Notes

- Shipping costs are paid by the buyer at checkout, on top of the item price. We collect that amount and pay the carrier for the label, so it is not part of the seller payout
- Sellers must ship within reasonable time after payment
- Sellers are responsible for proper packaging, which means a rigid cardboard box within the declared dimensions and weight
- Platform provides tools but is not responsible for delivery issues

### Payment Processing

#### Payment Provider and Legal Structure

All payments on BabyMarket.deals are handled exclusively by Stripe Payments Europe Limited, a licensed payment institution regulated by the Central Bank of Ireland under the EU Payment Services Directive (PSD2).

- When a buyer proceeds to checkout, they are redirected to Stripe's secure hosted payment page, where they can select iDEAL to complete payment
- BabyMarket.deals does not process, transmit, or store payment or banking information
- Funds are received and safeguarded by Stripe and then disbursed directly to the seller's verified Stripe Connect account
- At no point does BabyMarket.deals have access to or control over buyer or seller funds

**By completing a purchase on the platform, users agree that:**

- Stripe is the sole payment processor and custodian of funds
- All payments and payouts are governed by Stripe's Terms of Service (https://stripe.com/nl/legal/connect-account)
- BabyMarket.deals acts only as a technical intermediary between users and Stripe

#### How Payments Work

1. Buyer checkout: The buyer confirms their order and is redirected to a Stripe-hosted payment page
2. Payment completion: The buyer completes the payment securely via iDEAL, directly between their bank and Stripe
3. Platform fee deduction: BabyMarket.deals' platform service fee, together with the shipping cost the buyer paid, is automatically collected by Stripe through its Connect system. We use the shipping portion to pay the carrier for the label
4. Seller payout: 15 days after the purchase and at least 12 days after the carrier has scanned the parcel, whichever comes later, we release the payout and Stripe transfers the remaining funds, being the item price minus our service fee, minus Stripe's payout fees under Stripe Payout Fees, and minus any carrier surcharge recovered under Carrier Surcharges, to the seller's verified Stripe Connect account. Funds from an iDEAL payment settle about 7 days after the purchase; the further wait covers carrier corrections reported after delivery.

BabyMarket.deals never handles or holds any payment funds at any stage of the transaction. Funds remain with Stripe throughout, in the seller's own Stripe balance. What we do control is the timing of the payout to the seller's bank account, which we release 15 days after the purchase and at least 12 days after the carrier scan, whichever comes later.

#### Platform Fee

BabyMarket.deals charges a variable service fee that is automatically deducted by Stripe from each transaction before the seller payout. The amount Stripe collects for us also includes the shipping cost the buyer paid at checkout, because we buy the carrier label through our own shipping account and are invoiced for it directly. That shipping portion is passed on to the carrier and is not part of our service fee, and it is not part of the seller payout. The shipping amount shown at checkout is the full price the carrier quotes us for that label at that moment. A carrier can charge more afterwards for a parcel that was not packed or declared correctly, which is covered under Carrier Surcharges in the Shipping and Delivery section. The applicable fee is visible to sellers within their Stripe Connect dashboard after each transaction is processed. Stripe's fixed payment processing fee (€0.29 per iDEAL payment) is normally borne by the seller. When an item is offered for free there is no item price to deduct it from, so the buyer pays that fee at checkout instead, shown as its own line before payment.

For detailed fee structure and pricing information, please visit our [**Payment & Fees**](https://babymarket.deals/en/help-and-support/fees) page.

#### Stripe Payout Fees

Seller payouts are sent through our Stripe platform account, and Stripe charges us for every payout we send. We pass those charges on to the seller whose payout caused them, at the amount Stripe charges us including any VAT we have to pay on it, with no mark up: (a) €0.10 plus 0.25% of each payout, collected by Stripe together with our service fee when the buyer pays; (b) €2.00 once in every calendar month in which the seller receives at least one payout, deducted from the seller's Stripe balance when the first payout of that month is released; and (c) Stripe's fee of 1.4% on any amount we deduct from the seller's Stripe balance, under this clause or under Carrier Surcharges, added to that deduction. Including the VAT we have to pay on Stripe's fees, these come to about €0.12 plus 0.30% per payout, €2.42 per month and 1.7% per deduction. A month in which the seller receives no payout costs nothing. If a deduction would use up the whole payout, the monthly fee is not charged, because no payout is then sent. These fees apply to purchases made on or after October 6, 2026. If Stripe changes these prices, we update this clause before passing on a different amount.

#### When you are paid

Payouts are released 15 days after the purchase and at least 12 days after the carrier has scanned your parcel, whichever comes later, and are then transferred by Stripe to your bank account. The first 7 of those days are Stripe's: funds from an iDEAL payment settle 7 days after purchase and cannot be paid out sooner. The remaining days exist because carriers report packaging and size corrections to our shipping provider only days after delivery, so they are counted from the scan. Any such correction caused by the parcel is deducted from the payout at release, as described under Carrier Surcharges. Shipping promptly does not make a payout faster, but shipping late delays it. A payout is not released while the parcel is waiting at a pickup point for the buyer, and it is paused while we look into a parcel that the carrier reports as refused, returned to the seller or undeliverable.

#### Payment Disputes

- Refunds are initiated by the seller through Stripe; chargebacks are handled by the buyer's bank under the applicable network rules, with evidence submitted via Stripe
- The one exception is non-delivery: if a parcel has not reached the carrier 7 days after payment, we cancel the shipment and refund the buyer ourselves (see “If the seller never ships” under Returns & Refunds)
- Apart from that, BabyMarket.deals is not a party to financial disputes between users
- Item-related issues should be resolved between buyer and seller; payment-related issues follow Stripe/bank processes

#### Seller Verification and Compliance

- All sellers must complete Stripe's KYC (Know Your Customer) verification before receiving payouts
- Stripe acts as the data controller for identity verification and financial compliance under EU Anti-Money Laundering (AML) regulations
- BabyMarket.deals only receives confirmation of a seller's verification status and does not collect or store identity documents
- Stripe asks sellers in the Netherlands for their BSN (citizen service number) as part of this identity verification. It is entered only on Stripe's own pages; BabyMarket.deals never asks for, receives or stores it. Government information about the BSN: https://www.rvig.nl/informatie-over-een-datalek and https://www.rijksoverheid.nl/vraag-en-antwoord/privacy-en-persoonsgegevens/welke-organisaties-mogen-mijn-burgerservicenummer-bsn-gebruiken

#### Legal Responsibilities

- Stripe is responsible for payment processing and AML/KYC related to payouts
- BabyMarket.deals is responsible for operating the marketplace, platform-side risk controls, compliance with DAC7 and the Dutch Civil Code
- The platform acts as a technical intermediary and does not hold customer funds

### Returns & Refunds

**IMPORTANT: Apart from the non-delivery remedy below, we do not handle returns or refunds through the platform. You must arrange this directly with the seller.**

BabyMarket.deals is a platform, not a seller. Returns, refunds and warranties are handled directly between buyer and seller. We do not mediate disputes about an item's condition or description, and we do not provide purchase protection beyond the non-delivery remedy described below. Buyers should review the listing carefully and contact the seller to resolve any issues.

**Because all sellers are private individuals, EU consumer withdrawal rights for distance contracts with traders do not apply.**

#### If the seller never ships

Because we buy the shipping label ourselves, we can see whether a parcel has reached the carrier. When it has not, we act automatically so a buyer is not left without their item and without their money.

- Your payout is released 15 days after the purchase and at least 12 days after the carrier has scanned your parcel. Until then the funds remain in your Stripe balance and are not transferred to your bank account
- If the parcel has not reached the carrier 2 days after payment, we send you a reminder
- After 5 days we send a final warning setting out what happens next
- After 7 days we cancel the shipping label, refund the buyer in full, and pause your listings. The label stops working at that point, so the parcel must not be sent
- While this runs, we keep the buyer informed: they are told on day 5 what will happen, and again when the refund is issued
- If our shipping provider cannot tell us where a parcel is, we do not treat that as a failure to ship and the steps above are paused
- If you cannot ship an item, reply to any of these emails and we will resolve it with you

### Seller Types & Consumer Rights

All sellers on BabyMarket.deals are private individuals (not businesses) selling through Stripe Connect Individual accounts.

#### How We Verify Sellers

- All sellers must complete Stripe identity verification (KYC) before receiving payments
- Sellers confirm they are 18 or older when they sign up, and Stripe collects their date of birth as part of its verification
- Business sellers are not permitted on our platform
- Only private individuals can sell on BabyMarket.deals

**Age & Identity Verification** Stripe's verification confirms the identity of every seller before they can sell. Stripe decides which information it needs for that: for sellers in the Netherlands this includes the BSN and, when Stripe asks for one, an identity document. This protects both buyers and the platform.

### Listing Order & Ranking

Listings on BabyMarket.deals are ordered by the parameters below. They are set out here so that every seller knows how visibility works and every buyer knows why a listing is where it is.

#### Main Ranking Factors

- Recency. On the home page and in New arrivals, the newest listings appear first.
- Category pages. Within a category or subcategory, listings are ordered by their ranking date. A listing's ranking date is the day it was published, and it moves to the present moment only when the seller makes a qualifying price reduction, described below. Between two listings with the same ranking date, the more recently published one comes first.
- Search relevance. Search results are ordered by how well listings match your search terms, then by recency.
- Availability. Active listings are shown first; sold items stay visible for 30 days with a SOLD badge, then are archived.

#### Price Reductions

- A seller may edit a listing at any time while no purchase of it is in progress. Only a genuine price reduction changes its position: a reduction of at least 5% (and at least €1) below the lowest price the listing has ever had moves it to the top of its category and subcategory pages.
- After any price change the price is locked for 7 days. A listing can therefore move to the top at most once every 7 days, and only by being offered for less than ever before. Raising a price never improves a listing's position.
- When a price has been reduced, the previous price is shown next to the current one, on the listing and on category pages, so that everyone can see why the listing is where it is.

You can change the order you see using the price range, condition, new arrivals (30, 60 or 90 days) and category or subcategory filters.

We do NOT offer paid promotion or boosted listings, and placement cannot be bought. Every seller has the same means of visibility: publishing a listing and genuinely reducing its price.

## Stripe Updates

**Stripe update**

This section is not part of the BabyMarket.deals Terms of Service. Payments and payouts on BabyMarket.deals run through Stripe, and every seller holds their own Stripe account under Stripe's own terms. When Stripe changes those terms, Stripe asks us to pass the notice on to you. We do that here, separately from our own Terms.

This notice concerns every user who has a Stripe account through BabyMarket.deals, including users who started the seller setup and did not finish it. It does not concern buyers.

### Stripe Services Agreement

**Takes effect on: January 6, 2027 for existing Stripe accounts. A Stripe account created on or after September 28, 2026 is bound by the updated terms from the day it was created.**

Stripe has published an updated Stripe Services Agreement. It applies to your Stripe account through the Stripe Connected Account Agreement, which incorporates it. According to Stripe, the main changes are:

- New wording on AI agents: you remain responsible for what an AI agent does on your behalf when it uses Stripe's services
- Stripe Atlas is now covered by the main agreement
- New service terms for, among others, Payments, Billing, Financial Connections, Global Payouts (in regular currency and in stablecoin), Stablecoin Treasury, Managed Payments, Next Day Settlement and agentic commerce services
- An updated Data Processing Agreement and updated Link Payment Method Terms

You do not need to take any action. By continuing to use Stripe's services on or after January 6, 2027, you agree to the updated terms.

If you do not accept the updated terms, you must stop using Stripe's services and close your Stripe account before January 6, 2027. Stop selling on BabyMarket.deals and contact us so we can help you close your Stripe account. You can also close your BabyMarket.deals account from your account page.

### Stripe Privacy Policy

**Takes effect on: November 20, 2026**

Stripe is also updating its Privacy Policy. No action is needed from you. According to Stripe, the main changes are:

- Updates to how Stripe processes data for agentic payments, stablecoin and blockchain transactions, platform branded Issuing cards, machine learning risk predictions, insights shared with business users, lead data and third party app sync. Link now has its own separate Link Privacy Policy
- Clarifications of Stripe's roles in processing data, including that Stripe acts as an independent data controller for Atlas, Connect and Capital, and new terms for its Merchant of Record services
- Updates to its communication policies covering automated dialling, AI voice agents, and transcripts used for outreach and model training
- Updates to regional terms reflecting new local regulations and Stripe's global expansion

#### Active Accounts

Data retained while your account is active:

- Account information for authentication

What happens to a listing once it leaves the marketplace:

- Sold: removed from everyone's saved items as soon as it sells, then moved to our archive 30 days later
- Sold: photos and translations deleted after 2 years, and the archived record after 7 years, alongside the transaction record it belongs to
- Hidden by our moderation team: deleted 30 days after being hidden if the decision stands, and we email you when that happens

We implement appropriate technical and organizational measures to protect your personal data:

### Age Requirement

You must be at least 18 years old to buy or sell on BabyMarket.deals. This is required under Dutch law to enter into legally binding sales contracts.

We do not knowingly allow minors to complete transactions. Selling requires Stripe identity verification (which verifies age via government ID), and buying requires adult payment methods. If you believe a minor has completed a transaction, contact support@babymarket.deals immediately.

The 18+ requirement is necessary because transactions involve legally binding contracts, payment processing through Stripe, and shipping arrangements that require legal capacity.

### Changes to This Privacy Policy

We may update this privacy policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors.

#### How We Notify You

## Cookie Policy

### Essential Cookies and Privacy-Friendly Analytics

We use essential cookies required for platform functionality. These cookies do not require your consent under the ePrivacy Directive as they are strictly necessary for the service. The only other cookies on the site are Google Ads cookies, which are set only if you accept them (see Advertising Measurement below).

### Privacy-Friendly Analytics (Plausible)

We use Plausible Analytics, a privacy-focused analytics service that:

- Does NOT use cookies
- Does NOT collect personal data
- Does NOT track users across websites
- Is fully GDPR, CCPA, and PECR compliant
- Collects only anonymous aggregated statistics (page views, referrers, devices)
- Legal basis: Legitimate interest (GDPR Art. 6(1)(f)) for website improvement

### Advertising Measurement (Google Ads)

Only if you choose to accept them in the cookie banner, we load the Google Ads tag of Google Ireland Limited. It:

- Sets cookies on your device that record that you reached the site through one of our Google ads
- Tells Google, and through Google us, when such a visit leads to a new account whose email address is verified, so we can measure and improve our ads
- When you verify your email address, the site sets its own cookie holding a random code until the next page loads (at most 15 minutes), so that page can report the new account to Google Ads. If you accepted Google Ads cookies when you signed up, the browser you signed up in also keeps a random reference for up to 7 days, so it can report the new account once your email address is verified, wherever you opened the email. Nothing is sent to Google unless you accepted Google Ads cookies
- Lets Google show our ads to people who have visited the site, and gives us aggregate insights about our visitors
- Sends Google your device's online identifiers, the pages you view on the site and how you reached them
- Legal basis: your consent (GDPR Art. 6(1)(a)). If you choose Only Necessary Cookies, the tag is never loaded
- You can change your choice at any time with Cookie Settings at the bottom of every page
- Subject to Google's privacy policy: https://policies.google.com/privacy

### What We Don't Use

We do NOT use:

- Advertising cookies without your consent
- Social media tracking pixels
- Invasive tracking technologies

### WebSocket Connections for Platform Statistics

#### **Online User Counting**

For administrative purposes, we maintain a real-time count of online users through WebSocket connections.

**What We Collect:**

Only an anonymous aggregate count of active connections

**What We DON'T Collect:**

- No user identifications
- No browsing history
- No personal data
- No tracking of individual users

**How It Works:**

- When logged in, your browser maintains a WebSocket connection
- Periodic 'heartbeat' signals confirm you are active
- Server counts total active connections
- Individual user identity is never recorded
- Connection is closed when you log out or become inactive

**Data Storage: Maintained only in server memory (RAM), never persisted to database**

**Legal Basis: Legitimate interest in platform administration (GDPR Art. 6(1)(f))**

*This is a privacy-by-design implementation where we deliberately avoid collecting any personal data or tracking information.*

### Third-Party Services

When you complete transactions, third-party services may set their own cookies:

- Stripe (payment processing) - subject to Stripe's cookie policy
- Plausible Analytics - Does NOT use cookies (cookieless analytics)
- Google Ads (advertising measurement): only if you accept it in the cookie banner, see Advertising Measurement above

We do not control third-party cookies. Review their privacy policies for details.

### Your Cookie Controls

You can control cookies through your browser settings. Note that blocking essential cookies will prevent you from using key features like logging in.

**To manage cookies:**

- Chrome: Settings → Privacy and security → Cookies
- Firefox: Settings → Privacy & Security → Cookies
- Safari: Preferences → Privacy → Cookies
- Edge: Settings → Cookies and site permissions

## Automated Decision-Making

**BabyMarket.deals does NOT use automated decision-making or profiling that produces legal effects or similarly significantly affects you.**

All decisions regarding account restrictions, content moderation, or transaction disputes involve human review. We do not use algorithms or AI systems to make decisions that could significantly impact your rights without human oversight.

## Legal Framework

These terms and conditions are governed by Dutch law. Any disputes arising from or related to these terms shall be exclusively submitted to the competent courts in The Hague, Netherlands, unless mandatory law provides otherwise.
