Terms of Service

Platform Role & Responsibilities

BabyMarket.deals operates as an intermediary platform that connects buyers and sellers. We are not a party to any transaction between users.

What We Do

  • ✓ Provide a platform for users to list and browse items
  • ✓ Facilitate secure payments through Stripe Connect
  • ✓ Verify seller identities through Stripe KYC processes
  • ✓ Buy the carrier shipping label for each order and make it available to the seller
  • ✓ Hold the seller's payout until the carrier scans the parcel, and refund the buyer if it never does
  • ✓ Remove reported fraudulent listings and users

What We Don't Do

  • ✗ Guarantee the quality, condition, or authenticity of items
  • ✗ Mediate disputes between buyers and sellers about an item's condition or description
  • ✗ Process refunds or handle payment disputes, other than the non-delivery remedy described under Returns & Refunds
  • ✗ Provide general purchase protection or guarantees beyond that same remedy
  • ✗ Store, handle, or ship physical items

User Responsibilities

All Users Must

  • Provide accurate and complete registration information
  • Comply with Dutch law and these terms of service
  • Resolve disputes directly with other users
  • Report suspicious activity to support@babymarket.deals

Sellers Must

  • Own the items they list or have legal right to sell them
  • Provide accurate descriptions and photos
  • Complete Stripe onboarding and identity verification
  • Ship items promptly after payment
  • Respond to buyer inquiries in good faith
  • Remove a listing as soon as the item is sold or no longer available, including when it has been sold through another channel

Buyers Must

  • Pay for items they purchase
  • Provide accurate delivery information
  • Contact sellers directly for transaction issues
  • Use external dispute resolution for payment problems

Eligibility & Account Requirements

You must be at least 18 years old to buy or sell items on BabyMarket.deals

Currently available only to users in the Netherlands

You must have legal capacity to enter into binding contracts

Account Rules

  • One account per person - multiple accounts are prohibited
  • Provide accurate and current information
  • Keep your password secure and confidential
  • You are responsible for all activity under your account
  • Do not share, sell, or transfer your account

Intellectual Property & User Content

Our Trademark

The BabyMarket.deals logo (figurative mark with word elements) is a registered Benelux trademark held by BabyMarket.deals — BOIP registration number 1543903, registered on 19 May 2026 and valid until 19 May 2036. Unauthorized reproduction or imitation of the logo, including in favicons, social media branding, listings, or look-alike marks that may confuse users, is prohibited. For trademark inquiries or to report misuse, email support@babymarket.deals.

Your Content

You retain ownership of content you upload (photos, descriptions, etc.). However, by posting content on BabyMarket.deals, you grant us:

License Grant

Worldwide, non-exclusive, royalty-free, sublicensable license to:

  • Display your listings on the platform
  • Translate your content (automatic EN/NL translation)
  • Store and reproduce content for backup and security
  • Modify content for technical compatibility and listing accuracy, including the following adjustments:
    • Resize, compress and re-encode images for performance, security and consistent display across devices
    • Correct the category and sub-category of a listing when it is miscategorized, so it is discoverable by the right buyers
    • Adjust declared package dimensions (length, width, height) and weight so that shipping costs are calculated accurately and available carriers are shown correctly at checkout
    • Remove individual images that contain personal information, copyrighted material, faces of minors, or otherwise violate our policies

This license lasts as long as your content is on the platform and for a reasonable period after removal for backup and legal compliance.

Your Responsibilities

By posting content, you confirm that:

  • You own the content or have permission to use it
  • Content does not infringe third-party intellectual property rights
  • Content complies with these Terms and applicable law

Copyright Infringement Reports

If you believe content on our platform infringes your copyright, email support@babymarket.deals with:

  • Description of the copyrighted work
  • URL of the allegedly infringing content
  • Your contact information
  • Statement of good faith belief that use is unauthorized
  • Statement that information is accurate and you are authorized to act

We will investigate and may remove infringing content. Repeat infringers may have their accounts terminated.

Prohibited Activities

  • Listing stolen, counterfeit, or illegal items
  • Fraud, misrepresentation, or deceptive practices
  • Attempting to circumvent platform fees
  • Creating multiple accounts to avoid restrictions
  • Harassment or abusive behavior toward other users
  • Infringing intellectual property rights
  • Scraping or automated data collection
  • Interfering with platform security or functionality

Product Safety & Prohibited Baby Items

For children's safety, the following items are prohibited or restricted:

  • Any item subject to an EU recall or safety alert (EU Safety Gate/RAPEX)
  • Car seats without original homologation labels, with crash history, or past manufacturer's service life
  • Cribs/crib mattresses that do not meet EU safety standards or have missing/modified parts
  • Used breast pumps unless all fluid-contact parts are new/sealed and hygienic
  • Helmets or protective gear with impacts, cracks, or past expiry dates
  • Toys lacking CE marking or with removed/altered safety information
  • Counterfeit, unsafe, or otherwise illegal products

We may remove listings that appear unsafe or non-compliant and may restrict accounts for repeated violations.

Account Termination

By You

You may delete your account at any time from your Account settings. Upon deletion:

  • Account deleted immediately upon request
  • Active listings are removed immediately
  • Transaction history retained for 7 years (legal requirement)
  • You lose access to your account and any pending payouts

By BabyMarket.deals

We may suspend or terminate your account if:

  • You violate these Terms of Service
  • You engage in fraudulent or illegal activity
  • Your account poses security risks
  • Required by law or regulatory authorities

Notice: We will provide notice where reasonably possible, but may terminate immediately for serious violations.

Appeals: You may appeal termination decisions by contacting support@babymarket.deals

Limitation of Liability

To the maximum extent permitted by Dutch law:

  • BabyMarket.deals is not liable for damages arising from transactions between users
  • We do not guarantee continuous, error-free platform operation
  • Users engage in transactions at their own risk
  • We are not responsible for user-generated content or third-party services

Dispute Resolution

Step 1: Direct Resolution

Users must first attempt to resolve disputes directly with each other.

Step 2: Report to Platform

If direct resolution fails, report issues to support@babymarket.deals. We may:

  • Investigate reported violations
  • Remove fraudulent listings or users
  • Provide user contact information for legal proceedings

Step 3: External Channels

For payment disputes or legal issues:

  • Contact your bank for payment disputes or chargebacks
  • Use consumer protection agencies
  • Seek legal advice for significant losses
  • Report criminal activity to local police

Shipping & Delivery

Shipping Responsibility

BabyMarket.deals does not handle, store, or ship any physical items. We buy the carrier label on the seller's behalf through our own shipping account and make it available to the seller. Packaging the item, and handing the parcel over to the carrier at a drop off point, remain the responsibility of the seller.

How Shipping Works

  • Buyer selects shipping method during checkout with real-time pricing
  • Shipping cost is calculated automatically based on package specs
  • Seller receives payment and shipping notification
  • We buy the shipping label from the carrier and make it available to the seller
  • Seller packages the item and drops the parcel off at the carrier
  • Tracking number is shared with buyer

Package Dimensions, Category & Review Process

Accurate category selection, package dimensions, and package weight are essential for correct carrier pricing, label generation, delivery handling, and search results. Sellers must list each item in the most appropriate category and subcategory, and must enter package details that reasonably match the listed item and its packaging.

  • Package dimensions and weight must reflect the actual parcel size and weight, not placeholder values or estimates that are clearly too small
  • Each listing must describe one sellable item or one logical bundle that can be shipped together in a single parcel
  • If a listing appears inconsistent, for example a stroller declared as 1 x 1 x 1 cm, a large item placed in the wrong category, or multiple large items combined in one listing, we may review the listing manually
  • When the correct category, subcategory, package dimensions, or package weight are reasonably clear from the listing title, description, photos, or product type, we may update the listing ourselves to keep the marketplace accurate and the shipping calculation reliable
  • If we update a listing, we may notify the seller by email with the changes made and the reason for the update
  • If the issue cannot be corrected by us, or if the listing needs seller input, we may email the seller to request clarification or corrected information
  • If no reply is received, we may send one reminder after 24 to 48 hours
  • If no reply arrives after that reminder, or if the listing cannot be safely corrected, we may hide or cancel the listing until the issue is resolved
  • The seller may contact us if they believe a correction was made in error

Available Carriers

We provide integrated shipping solutions with access to multiple carriers:

  • PostNL (standard and express options)
  • DHL (express delivery)
  • DPD (next-day delivery)
  • UPS, FedEx, GLS, and other available carriers

Important Notes

  • Shipping costs are paid by the buyer at checkout, on top of the item price. We collect that amount and pay the carrier for the label, so it is not part of the seller payout
  • Sellers must ship within reasonable time after payment
  • Sellers are responsible for proper packaging
  • Platform provides tools but is not responsible for delivery issues

Payment Processing

Payment Provider and Legal Structure

All payments on BabyMarket.deals are handled exclusively by Stripe Payments Europe Limited, a licensed payment institution regulated by the Central Bank of Ireland under the EU Payment Services Directive (PSD2).

  • When a buyer proceeds to checkout, they are redirected to Stripe's secure hosted payment page, where they can select iDEAL to complete payment
  • BabyMarket.deals does not process, transmit, or store payment or banking information
  • Funds are received and safeguarded by Stripe and then disbursed directly to the seller's verified Stripe Connect account
  • At no point does BabyMarket.deals have access to or control over buyer or seller funds

By completing a purchase on the platform, users agree that:

  • Stripe is the sole payment processor and custodian of funds
  • All payments and payouts are governed by Stripe's Terms of Service (https://stripe.com/nl/legal/connect-account)
  • BabyMarket.deals acts only as a technical intermediary between users and Stripe

How Payments Work

  1. Buyer checkout: The buyer confirms their order and is redirected to a Stripe-hosted payment page
  2. Payment completion: The buyer completes the payment securely via iDEAL, directly between their bank and Stripe
  3. Platform fee deduction: BabyMarket.deals' platform service fee, together with the shipping cost the buyer paid, is automatically collected by Stripe through its Connect system. We use the shipping portion to pay the carrier for the label
  4. Seller payout: once the carrier scans the parcel we release the payout, and Stripe transfers the remaining funds, being the item price minus our service fee, to the seller's verified Stripe Connect account. Funds from an iDEAL payment settle about 7 days after the purchase, so that is the earliest a payout can arrive.

BabyMarket.deals never handles or holds any payment funds at any stage of the transaction. Funds remain with Stripe throughout, in the seller's own Stripe balance. What we do control is the timing of the payout to the seller's bank account, which we release once the carrier scans the parcel.

Platform Fee

BabyMarket.deals charges a variable service fee that is automatically deducted by Stripe from each transaction before the seller payout. The amount Stripe collects for us also includes the shipping cost the buyer paid at checkout, because we buy the carrier label through our own shipping account and are invoiced for it directly. That shipping portion is passed on to the carrier and is not part of our service fee, and it is not part of the seller payout. No VAT is added to our platform fees. The shipping amount shown at checkout is the full price the carrier charges us for the label. The applicable fee is visible to sellers within their Stripe Connect dashboard after each transaction is processed. Stripe's fixed payment processing fee (€0.29 per iDEAL payment) is normally borne by the seller. When an item is offered for free there is no item price to deduct it from, so the buyer pays that fee at checkout instead, shown as its own line before payment.

When you are paid

Payouts are released after the carrier scans your parcel, and are then transferred by Stripe according to its payout schedule. Funds from an iDEAL payment settle about 7 days after purchase, so that is the earliest a payout can reach your bank account. Shipping promptly does not make a payout faster, but shipping late delays it.

Payment Disputes

  • Refunds are initiated by the seller through Stripe; chargebacks are handled by the buyer's bank under the applicable network rules, with evidence submitted via Stripe
  • The one exception is non-delivery: if a parcel has not reached the carrier 10 days after payment, we cancel the shipment and refund the buyer ourselves (see “If the seller never ships” under Returns & Refunds)
  • Apart from that, BabyMarket.deals is not a party to financial disputes between users
  • Item-related issues should be resolved between buyer and seller; payment-related issues follow Stripe/bank processes

Seller Verification and Compliance

  • All sellers must complete Stripe's KYC (Know Your Customer) verification before receiving payouts
  • Stripe acts as the data controller for identity verification and financial compliance under EU Anti-Money Laundering (AML) regulations
  • BabyMarket.deals only receives confirmation of a seller's verification status and does not collect or store identity documents

Legal Responsibilities

  • Stripe is responsible for payment processing and AML/KYC related to payouts
  • BabyMarket.deals is responsible for operating the marketplace, platform-side risk controls, compliance with DAC7 and the Dutch Civil Code
  • The platform acts as a technical intermediary and does not hold customer funds

Returns & Refunds

IMPORTANT: Apart from the non-delivery remedy below, we do not handle returns or refunds through the platform. You must arrange this directly with the seller.

BabyMarket.deals is a platform, not a seller. Returns, refunds and warranties are handled directly between buyer and seller. We do not mediate disputes about an item's condition or description, and we do not provide purchase protection beyond the non-delivery remedy described below. Buyers should review the listing carefully and contact the seller to resolve any issues.

Because all sellers are private individuals, EU consumer withdrawal rights for distance contracts with traders do not apply.

If the seller never ships

Because we buy the shipping label ourselves, we can see whether a parcel has reached the carrier. When it has not, we act automatically so a buyer is not left without their item and without their money.

  • Your payout is released once the carrier scans your parcel. Until then the funds remain in your Stripe balance and are not transferred to your bank account
  • If the parcel has not reached the carrier 2 days after payment, we send you a reminder
  • After 5 days we send a final warning setting out what happens next
  • After 10 days we cancel the shipping label, refund the buyer in full, and pause your listings. The label stops working at that point, so the parcel must not be sent
  • While this runs, we keep the buyer informed: they are told on day 5 what will happen, and again when the refund is issued
  • If our shipping provider cannot tell us where a parcel is, we do not treat that as a failure to ship and the steps above are paused
  • If you cannot ship an item, reply to any of these emails and we will resolve it with you

Seller Types & Consumer Rights

All sellers on BabyMarket.deals are private individuals (not businesses) selling through Stripe Connect Individual accounts.

How We Verify Sellers

  • All sellers must complete Stripe identity verification (KYC) before receiving payments
  • Stripe verifies sellers are 18+ via government-issued ID
  • Business sellers are not permitted on our platform
  • Only private individuals can sell on BabyMarket.deals

Age & Identity Verification Stripe's verification process ensures all sellers meet legal age requirements and confirms their identity through official documentation. This protects both buyers and the platform.

Listing Order & Ranking

Listings on BabyMarket.deals are ordered by the parameters below. They are set out here so that every seller knows how visibility works and every buyer knows why a listing is where it is.

Main Ranking Factors

  • Recency. On the home page and in New arrivals, the newest listings appear first.
  • Category pages. Within a category or subcategory, listings are ordered by their ranking date. A listing's ranking date is the day it was published, and it moves to the present moment only when the seller makes a qualifying price reduction, described below. Between two listings with the same ranking date, the more recently published one comes first.
  • Search relevance. Search results are ordered by how well listings match your search terms, then by recency.
  • Availability. Active listings are shown first; sold items stay visible for 30 days with a SOLD badge, then are archived.

Price Reductions

  • A seller may edit a listing at any time while no purchase of it is in progress. Only a genuine price reduction changes its position: a reduction of at least 5% (and at least €1) below the lowest price the listing has ever had moves it to the top of its category and subcategory pages.
  • After any price change the price is locked for 7 days. A listing can therefore move to the top at most once every 7 days, and only by being offered for less than ever before. Raising a price never improves a listing's position.
  • When a price has been reduced, the previous price is shown next to the current one, on the listing and on category pages, so that everyone can see why the listing is where it is.

You can change the order you see using the price range, condition, new arrivals (30, 60 or 90 days) and category or subcategory filters.

We do NOT offer paid promotion or boosted listings, and placement cannot be bought. Every seller has the same means of visibility: publishing a listing and genuinely reducing its price.

Digital Services Act (DSA) Compliance

Report Illegal Content or Listings

If you encounter illegal content, fraudulent listings, or prohibited items:

  • Use the "Report Listing" button on any listing page
  • Email support@babymarket.deals with details
  • Use the Contact form under Help & Support

Valid Notice Requirements

To help us act quickly, include the following in your report:

  • URL or exact ID of the content you report
  • Description of why the content is illegal or violates our Terms
  • Reference to the legal basis (if applicable) and the relevant country
  • Your name and contact email for follow-up
  • A good-faith statement that the information in your notice is accurate

Our Review Process

  • Reports reviewed within 24-48 hours
  • Content may be removed immediately if clearly illegal
  • User notified of decision with reasoning
  • Appeals can be submitted to support@babymarket.deals
  • A listing hidden while we review it is deleted 30 days later if the decision stands, and we email you again when it is

When we remove content or restrict accounts, we will notify you via email with:

  • Clear reasoning based on our Terms of Service
  • Which specific terms were violated
  • Your right to appeal the decision

Internal Complaints & Out-of-Court Settlement

If your content is removed or your account is restricted, you can appeal using our internal complaint process via support@babymarket.deals. We review complaints within a reasonable period and provide reasons for our decision. You may also seek resolution through certified out-of-court dispute settlement bodies as foreseen by the Digital Services Act.

Service Availability & Warranties

No Warranty

BabyMarket.deals is provided "as is" and "as available" without warranties of any kind, express or implied, including:

  • Merchantability or fitness for particular purpose
  • Uninterrupted or error-free operation
  • Accuracy or reliability of content
  • Security of user-generated content

We strive for 24/7 availability but do not guarantee continuous access. The platform may be unavailable due to maintenance, updates, or technical issues.

Force Majeure

  • Natural disasters, pandemics, war
  • Internet service provider failures
  • Government actions or legal restrictions
  • Third-party service outages (Stripe, shipping providers, etc.)

General Provisions

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations to a successor entity.

Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and BabyMarket.deals.

Language

These Terms are provided in English and Dutch. In case of conflict, the English version prevails.

Updates

We may update these Terms. Changes take effect when they are published on this page with a new effective date, and are announced in the platform when they reduce your rights or add obligations for you. A change does not alter the terms that applied to a purchase or a listing already in progress when it was published. If you do not accept a change, stop using the platform; you may delete your account at any time. Continued use after a change is published constitutes acceptance.

  • Non-NL visitors are blocked from accessing the platform and registering as sellers
  • No other data is collected or stored by this service on our behalf
  • Subject to ip-api.com's privacy policy

Translation Service (DeepL)

Used to automatically translate listing content between English and Dutch

  • Listing titles and descriptions are sent for translation
  • Subject to DeepL's privacy policy

No Commercial Data Selling

We do not sell your personal data to third parties for marketing purposes.

Controller & Processor Roles

BabyMarket.deals: BabyMarket.deals is the data controller for marketplace accounts, listings, orders, and platform security.

Stripe: Stripe is an independent controller for payment processing, seller verification (KYC), and compliance data under its own privacy policy.

Sendcloud: Our shipping provider is typically an independent controller for shipping label creation and tracking data under its own privacy policy.

International Data Transfers

Some of our service providers may process data outside the European Economic Area (EEA):

Payment processing may involve transfers to the US. Stripe is certified under the EU-US Data Privacy Framework and uses Standard Contractual Clauses (SCCs) approved by the European Commission.

We may request proof of identity to verify your request (ID verification protects your privacy).

We will respond within one month of receiving your request. In complex cases, we may extend this by two additional months and will inform you of any delay.

Exercising your rights is free of charge, unless requests are manifestly unfounded or excessive.

Important Limitations

Certain data cannot be deleted due to legal obligations and compliance requirements:

  • Transaction records must be retained for 7 years (Dutch tax law)
  • Seller verification records retained for 7 years (AML/KYC regulations)
  • Payment audit trail for tax and financial compliance
  • Active restrictions may limit deletion rights during investigations

Data Retention

We retain personal data only as long as necessary to fulfill legal obligations and provide services.

Listings

What happens to a listing once it leaves the marketplace:

  • Sold: removed from everyone's saved items as soon as it sells, then moved to our archive 30 days later
  • Sold: photos and translations deleted after 2 years, and the archived record after 7 years, alongside the transaction record it belongs to
  • Hidden by our moderation team: deleted 30 days after being hidden if the decision stands, and we email you when that happens
  • Deleted by you: the listing, its photos and its translations are removed straight away, and the same applies to your unsold listings when you close your account
  • A record of a listing removed by our moderation team, including the reason given, is kept for 2 years as an audit trail

Transaction Data (7 Years)

Deleted Accounts

When you delete your account:

Age Requirement

You must be at least 18 years old to buy or sell on BabyMarket.deals. This is required under Dutch law to enter into legally binding sales contracts.

We do not knowingly allow minors to complete transactions. Selling requires Stripe identity verification (which verifies age via government ID), and buying requires adult payment methods. If you believe a minor has completed a transaction, contact support@babymarket.deals immediately.

The 18+ requirement is necessary because transactions involve legally binding contracts, payment processing through Stripe, and shipping arrangements that require legal capacity.

  • When logged in, your browser maintains a WebSocket connection
